Two principals in a Texas school district, Lindsey Lujan and Jesus Lujan, are facing criminal charges for allegedly violating state election laws. The couple, who work in the Denton Independent School District, are accused of using their school emails to urge staff to vote for candidates who oppose school choice. They sent emails in February encouraging staff to vote in the Republican primary for candidates against Gov. Greg Abbott’s school voucher plan. This action prompted Texas Attorney General Ken Paxton to file a lawsuit against the school district and the principals were charged with unlawful use of an internal mail system for political advertising.

As a result of the emails being leaked in February, the principals have been charged with a Class A misdemeanor, which carries a maximum penalty of up to a year in jail and a $4,000 fine. The Texas American Federation of Teachers, a teachers union, believes the charges are politically motivated and an attack on educators and school employees who are fulfilling their duty to promote civic engagement. They argue that this legal action could have a chilling effect on communities across the state as individuals may feel apprehensive about participating in the election process.

In response to the charges, the school district stated that election laws should be followed, but also encouraged individuals to learn about the candidates and their positions before voting in the primary of their choosing. The district’s stance aims to promote informed decision-making among voters, while still respecting the legal boundaries set forth by the state. Despite this, the legal action taken against the principals has sparked debate and concern among educators and the broader community.

Lindsey Lujan is scheduled for a court hearing next month, while her husband Jesus Lujan’s hearing is set for June. The outcome of these legal proceedings will likely have implications for the future of educators engaging in political activity within the school system. The case has highlighted the intersection of education, politics, and the law, drawing attention to the complexities and challenges faced by school administrators in navigating these interconnected spheres. Ultimately, the outcome of this case will have broader implications for educators and school employees in Texas and potentially beyond.
