The State Department’s Vedant Patel emphasized that no definitive conclusions have been reached by the U.S. regarding potential violations of international law by Israel in Gaza. Patel highlighted the complexity of the situation, with Hamas using civilians and civilian infrastructure as shields, making it difficult to determine if Israel intentionally targeted civilians. However, Israel is currently conducting criminal investigations and administrative reviews to hold itself accountable for its actions. Secretary of State Antony Blinken’s report to Congress acknowledged that Israel’s use of U.S. weapons in Gaza likely violated international humanitarian law due to the challenges posed by Hamas embedding itself within the civilian population.

The report outlined Hamas’s intentional use of civilian facilities for military purposes, such as schools, hospitals, and residential buildings, as well as holding hostages in Gaza. While the U.S. recognizes the need to minimize civilian casualties, the presence of human shields complicates the assessment of potential violations of international law. Blinken criticized Israel’s tactics in Gaza, stating that they have led to the loss of innocent civilian lives without effectively neutralizing Hamas leaders and fighters. He emphasized the importance of Israel developing credible plans for security and governance in Gaza post-war to prevent a lasting insurgency.

Blinken noted concerns about the resurgence of Hamas in Gaza, particularly in Rafah, and warned against heavy military action that could harm the civilian population without solving the underlying issue. The U.S. has been working with Arab countries and others to develop plans for security, governance, and rebuilding in Gaza but has not seen similar efforts from Israel. Blinken cautioned that pushing deeper into Rafah could result in Israel inheriting an insurgency or chaos if Hamas is unable to govern the territory. He stressed the importance of finding a better way to achieve enduring security in Gaza.

Israel’s handling of the conflict was criticized for potentially leading to chaotic consequences in Gaza. Blinken warned that without a plan for security and governance, Israel risks leaving a power vacuum that could be filled by unrest or a return of Hamas. The U.S. is advocating for a more strategic approach to the situation to prevent long-term instability and ensure lasting security. The Associated Press contributed to the coverage of these developments.
