Vietnamese property tycoon Truong My Lan was sentenced to death for her involvement in the country’s largest financial fraud case. Lan, the chairwoman of Van Thinh Phat Holdings Group, was found guilty of embezzlement, bribery, and violating banking rules. She was sentenced to death for embezzlement and to 20 years in prison for the other two charges. Lan was accused of taking out unlawful loans from Saigon Joint Stock Commercial Bank and shell companies, leading to a total of $44 billion in loans, which accounted for over 90% of SCB’s lending between 2012 and 2022. Lan was arrested in 2022, with allegations dating back around 10 years.

Lan’s defense claimed that she only controlled around 15% of the bank and did not hold an official position, arguing that embezzlement charges were not appropriate. However, witnesses revealed that they were instructed to act on Lan’s behalf, leading judges to believe that Lan controlled over 90% of SCB through proxies and was the de-facto owner of the bank. Some of the loans were allegedly funneled to Van Thinh Phat, while others were used privately. Lan settled some of the loans, but the court ordered her to fully compensate the bank. Over 1,000 loans were involved in the case, and more than 80 other people, including central bank officials, were charged in connection with damaging SCB.

The sentencing of Truong My Lan is part of a broader crackdown on corruption in Vietnam led by the ruling Communist party, known as the “blazing furnace.” The campaign has led to the resignation of high-level politicians, including former Vietnamese presidents, and the conviction of hundreds of officials and businesspeople. Lan plans to appeal the sentence, according to a report from a family member. The case against Lan highlights the government’s efforts to tackle corruption and financial fraud in the country. The involvement of central bank officials and other individuals in the case demonstrates the widespread nature of corruption in the financial sector.

The embezzlement case involving Truong My Lan sheds light on the challenges faced by Vietnam in combating corruption and financial fraud. The massive loans taken out by Lan from SCB and the alleged misappropriation of funds highlight the need for greater oversight and regulation in the banking sector. The sentencing of Lan to death reflects the seriousness with which the government is addressing financial crimes in the country. The appeal by Lan suggests that the case is far from over, and further investigation and legal proceedings are likely to follow.

The legal proceedings against Truong My Lan raise questions about corporate governance, transparency, and accountability in Vietnam’s business sector. The involvement of a prominent property tycoon in such a significant financial fraud case underscores the importance of ethical business practices and regulatory compliance. The sentencing of Lan to death sends a strong message about the consequences of engaging in fraudulent activities and embezzlement. The broader implications of this case for the business community and the financial sector in Vietnam remain to be seen, but it is clear that the government is committed to rooting out corruption and holding those responsible to account.
