Nicaragua has launched a legal battle at the International Court of Justice against Germany, a major supplier of arms to Israel, alleging that Germany is facilitating genocide in Gaza and violating the Genocide Convention by aiding Israel financially and militarily. Nicaragua is seeking emergency measures to order Germany to cease its support to Israel. The case also accuses Germany of enabling grave breaches of the Geneva Conventions by Israel, particularly in failing to protect civilians during armed conflict. Germany, as Israel’s second-largest arms provider, has granted jurisdiction to the International Court of Justice, making it an easier target for a lawsuit compared to the United States, which denies its jurisdiction.

This case is the third this year at the court related to the Israeli-Palestinian conflict. South Africa previously sought emergency measures from the court, claiming that Israel was at risk of committing genocide, which Israel vehemently denied. The court later ordered Israel to ensure compliance with the Genocide Convention. South Africa also addressed the issue of hunger in Gaza, resulting in a ruling that required Israel to allow the delivery of essential supplies without delay. The United Nations General Assembly also brought a case to the court on the legality of Israel’s occupation of Palestinian territories, resulting in hearings that highlighted global frustration with Israel’s actions in Gaza.

The Nicaraguan case expands the scope of previous cases by addressing violations of the Geneva Conventions and the convention against genocide, as well as the protection of civilians. It accuses Israel of unlawful conduct in the occupied territories, going beyond the focus on starvation and genocide. While the court has not formally accepted the case yet, it is required to respond quickly to requests for emergency measures, such as those demanded by Nicaragua. Israel, not directly involved in the dispute between Nicaragua and Germany, will not appear in the upcoming hearings but has faced increased international pressure through these legal actions.
