Leonel Moreno, known as the “migrant influencer,” is facing potential federal firearms charges after mocking America on social media and encouraging migrants to squat in the homes of US citizens. Internal federal documents reveal that the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) have been in contact with Immigration and Customs Enforcement (ICE) regarding Moreno and are considering charges against him. While the exact charges are unknown, sources suggest they would likely be related to a section of the gun control act prohibiting those on parole from possessing firearms or ammunition. Moreno entered the US illegally in 2022 but was allowed to stay under a Biden administration-approved parole scheme. He was arrested in Ohio after failing to appear for required check-ins and posting incendiary social media content.

Former ICE field office director John Fabbricatore believes that additional charges would escalate the case against Moreno and possibly prolong his custody. If the ATF were to pursue charges, they would have to issue a warrant for Moreno to appear before a magistrate judge and be transferred into US Marshals’ custody. The Geauga County Jail has confirmed that Moreno remains in custody on behalf of ICE. Fabbricatore emphasized the seriousness of charges under the Gun Control Act and warned illegal aliens about the consequences of possessing a firearm unlawfully.

In his social media posts, Moreno is seen holding firearms in a gun store and flaunting cash while claiming to receive government handouts. Although he mentioned having a license and being able to purchase guns in stores, there is no evidence that he actually bought a gun. Authorities have not disclosed what was seized from the hotel where he was staying when arrested. Former ATF special agent Peter Forcelli suggests that the ATF is likely considering charges against Moreno because he is an illegal alien in possession of a firearm transported across state lines, especially given his advocacy for taking over people’s homes.

ICE confirmed that Moreno, a citizen of Venezuela who illegally entered the US in 2022, was placed in the Alternatives To Detention program and failed to report as required. He was subsequently arrested in Ohio and is detained pending further immigration proceedings. ICE records show that Moreno was known for encouraging illegal immigration on TikTok. The Post interviewed Moreno’s wife, who tearfully expressed not knowing where he was taken or being allowed to see him. She indicated a lack of information about his situation.

The Post’s investigation into Moreno’s social media presence and his arrest sheds light on the potential legal consequences of his actions advocating for illegal activities and firearm possession. It highlights the complex interactions between immigration, law enforcement, and social media influence in current US society. The uncertain nature of the charges he may face, coupled with his status as an illegal alien, adds layers of complexity to his case and the potential outcomes of the investigation. The involvement of federal agencies like ATF and ICE underscores the seriousness of the situation and the consequences Moreno may be facing as a result of his actions.
