Bruce Lehrmann, a former federal Liberal staffer, lost his multimillion-dollar defamation suit against Network Ten and Lisa Wilkinson after a judge found they had proven that Lehrmann raped his then-colleague Brittany Higgins in Parliament House. Federal Court Justice Michael Lee upheld Ten and Wilkinson’s truth defense in a historic decision, stating that they had proven, to the civil standard, that Lehrmann had raped Higgins in the office of their then-boss, Liberal senator Linda Reynolds, in March 2019. Lee determined that it was more likely than not that Lehrmann had disregarded Higgins’ consent and proceeded with sexual intercourse for his own gratification.

The decision by Justice Lee does not constitute a finding of criminal guilt, as it is based on the balance of probabilities rather than beyond reasonable doubt. Lehrmann’s criminal trial was halted in October 2022 due to juror misconduct, and the charges were eventually dropped due to concerns about Higgins’ mental health.
