Environmental liabilities can come back to haunt even the wealthiest individuals and companies, as shown in a case involving Comstock Resources and the Baucum family in Laurel, Mississippi. Comstock sold an oilfield in Laurel to Petro Harvester in 2010, but concerns about environmental damage were raised during the due diligence process. Despite this, Petro Harvester went ahead with the acquisition, and Comstock moved on with its business, eventually transforming into a shale gas pure play focused on drilling in the Haynesville field of Louisiana.

However, the environmental liabilities from the Laurel oilfield have resurfaced, with the Baucum family claiming that toxins buried on the site have migrated to their property, causing health issues including cancer. The Mississippi Supreme Court ruled in favor of the Baucums, allowing the case to proceed to trial, which is set to begin this month. Petro Harvester, which had acquired the assets from Comstock, filed for bankruptcy, leaving Comstock potentially liable for the environmental damages.

Experts believe that the contamination in the area may require extensive remediation efforts, including the installation of a subterranean wall to prevent further migration of toxins. The Baucums fear that the cleanup efforts by Formentera Energy, who bought the assets out of bankruptcy, may not be sufficient enough to address the contamination. Allegations of intimidation by Comstock attorneys and efforts to keep Jerry Jones, the majority owner of Comstock, from being mentioned at trial have added to the complexities of the case.

The case highlights the challenges and risks associated with environmental liabilities in the oil and gas industry, as well as the potential financial and reputational impacts on companies involved. The lack of disclosure of this litigation to public shareholders raises questions about the transparency and accountability of Comstock and whether there are additional undisclosed environmental or legal liabilities that could impact the company in the future. The outcome of the trial and the potential ramifications for Comstock and other parties involved remain uncertain, but the case serves as a cautionary tale for companies and investors regarding the importance of addressing environmental concerns responsibly.
