Legal expert Glenn Kirschner analyzed the federal election obstruction case against former President Donald Trump and accused Trump of “injecting politics” into the proceedings. U.S. District Judge Tanya Chutkan recently released a trove of documents related to Trump’s alleged criminal attempt to overturn the 2020 election results, which Trump’s lawyers objected to due to its timing close to the presidential election. Despite Trump’s claims of a politically motivated “witch hunt,” the judge denied his legal team’s request to keep the filings sealed, stating that withholding information solely for political reasons could constitute election interference.

Glenn Kirschner, a former federal prosecutor and frequent Trump critic, discussed the accusations against Trump on his YouTube channel “Justice Matters.” He highlighted that Judge Chutkan was clear in her decision to not let politics influence the handling of the case, signaling to Trump that he was the one introducing political considerations into the criminal proceedings. Many of the roughly 1,900 pages of documents released included redacted portions, believed to be related to grand jury testimony and FBI witness interviews. Publicly available information in the filings included a transcript of a phone call where Trump asked Georgia Secretary of State Brad Raffensperger to “find” votes and excerpts of Trump’s social media posts about the election.

The newly released documents also featured former Vice President Mike Pence’s letter to Congress explaining why he could not refuse to certify the 2020 election results on January 6, 2021. Kirschner speculated that redacted portions could be linked to unnamed co-conspirators mentioned in the federal indictment against Trump who have not been charged. Drawing parallels to Watergate, Kirschner compared the complexity and gravity of the crimes committed on and around January 6 to those of Richard Nixon, noting that the process of justice may be lengthy but vital for accountability. He expressed confidence in Special Counsel Jack Smith’s ongoing investigation, suggesting that more revelations and charges could emerge as the case progresses.
