A federal judge in Delaware denied Hunter Biden’s attempt to have gun charges against him dismissed, rejecting his claim that the case is politically motivated. Hunter Biden faced felony firearm possession and false statement charges brought by special counsel David Weiss. His lawyers argued that the case was selective and vindictive, alleging that it was a breach of separation of powers due to political pressure from former President Donald Trump and congressional Republicans. However, US District Judge Maryellen Noreika found the argument unconvincing, calling it “nonsensical.”

Noreika pointed out that it was the Biden Justice Department that brought charges against Hunter Biden, and Attorney General Merrick Garland, appointed by Joe Biden, oversaw them. She dismissed the notion that Hunter Biden was targeted because he is the son of the President, stating that there was no evidence of political influence in the case. The judge also rejected motions challenging the legitimacy of the indictment against Hunter Biden and Weiss’ special counsel appointment. She did not rule on a motion challenging the constitutionality of the gun charges.

Hunter Biden has pleaded not guilty to the charges in the gun case, which involve allegations of lying about drug use on a federal form when purchasing a firearm. He admitted to being addicted to crack cocaine at the time he purchased the weapon. In addition to the gun charges, Hunter Biden is facing nine counts related to tax fraud in a separate case in California. Prosecutors have accused him of failing to pay at least $1.4 million in taxes over three years while living an extravagant lifestyle. Earlier this month, his efforts to have charges in the tax fraud case dismissed also failed.

The judge’s ruling in Delaware adds to Hunter Biden’s legal challenges, as he faces multiple charges in separate cases. Despite his claims of political motivation behind the gun charges, the court found no evidence to support this argument. The involvement of the Biden Justice Department and the connection to his father, the President, did not sway the judge’s decision. Hunter Biden’s legal team has been unsuccessful in their attempts to have the charges dismissed, indicating that the legal process will continue to move forward in both the gun and tax fraud cases.
