Supreme Court Chief Justice John Roberts is under pressure to ensure that Justice Samuel Alito recuses himself from any 2020 election-related cases following controversy regarding flags flown at Alito’s homes around the time of the Capitol riot on January 6, 2021. Senate Judiciary Committee Chairman Dick Durbin and Chairman of the Judiciary Subcommittee on Federal Courts Sheldon Whitehouse wrote a letter to Roberts stating that Alito’s display of the upside-down and ‘Appeal to Heaven’ flags was deemed as political activity and failed to promote public confidence in the impartiality of the judiciary. They have called for Alito’s recusal in cases related to the 2020 presidential election and the Capitol attack.

Reports revealed that Alito’s homes flew the flags in question, leading to doubt about his impartiality and ability to discharge duties in relevant cases. The Supreme Court is yet to make a decision in the matter of former President Trump’s immunity claim in his federal election-interference case, where Alito’s inclusion could be significant due to the court’s conservative majority. Democratic senators are urging the court to adopt an enforceable code of conduct for the justices and are pushing for legislation enforcing such a code to be passed. Following the reports of the flags flying at Alito’s homes, he explained that the upside-down flag was raised due to a dispute with neighbors, while the ‘Appeal to Heaven’ flag was associated with historical context and a reference to fighting tyranny. Some lawmakers, however, are renewing calls to expand the Supreme Court in order to confirm more Democrat-appointed justices, with some arguing that Alito should recuse himself from cases related to the Capitol insurrection. Senator Ed Markey and Senator Tina Smith both emphasized the need for Supreme Court expansion to prevent the dismantling of democracy by right-wing extremists on the court.
