A federal appeals court ruled that Maryland’s largest public school system does not have to allow parents to opt their children out of lessons involving LGBTQ themes. The ruling was a response to a lawsuit filed by a group of parents in Montgomery County who believe that parents should have the responsibility of deciding whether their children participate in such lessons. The Becket Fund for Religious Liberty represented roughly 300 parents from different religious backgrounds who sought the ability to excuse their children from LGBTQ-inclusive materials in classrooms. The court’s decision was disappointing to the parents represented by the Becket Fund.

The issue of opting out of LGBTQ-inclusive curriculum has been a contentious one in Montgomery County, with thousands of parents participating in rallies, protests, and school board meetings. Some parents believe that materials involving sexuality are too mature for young children and should be optional, while others advocate for inclusive curriculum that reflects diversity and promotes acceptance. Book titles at the center of the controversy include “The Pride Puppy,” “Uncle Bobby’s Wedding,” and “Born Ready: The True Story of a Boy Named Penelope.” Parents who opposed the opt-out policy expressed concerns about where to draw the line when it comes to exposure to diverse perspectives in the classroom.

Despite their objections to the current policy, the group represented by the Becket Fund clarified that they are not seeking to have LGBTQ-inclusive books removed from classrooms. They simply want the ability to choose what materials are appropriate for their own children and have them excused from those lessons if necessary. The group believes that all parents should have the right to decide what is suitable for their children, regardless of differing perspectives. They are hoping for a review of the case by the U.S. Supreme Court to potentially yield a different outcome.

The court ruling, issued by a 2-1 panel of the 4th U.S. Circuit Court of Appeals in Richmond, Virginia, directly impacts the ability of Maryland parents to opt their children out of LGBTQ-inclusive book curricula. An MCPS spokesperson stated that they have not yet seen the ruling and therefore cannot comment on ongoing litigation. The Becket Fund for Religious Liberty remains committed to advocating for the rights of parents to make decisions about their children’s education and will continue to pursue legal avenues to address their concerns. The ruling reflects a broader debate about the role of parents in shaping their children’s education and the balance between promoting diversity and respecting individual beliefs.
