Rep. Alexandria Ocasio-Cortez of New York has demanded an investigation into reports that a flag associated with the January 6, 2021 Capitol riot was flown at Supreme Court Justice Samuel Alito’s home. She described this as a breach of trust and a challenge to democracy. Ocasio-Cortez called for active investigations and subpoenas to be issued, stating that there needs to be accountability in governance to defend democracy. A second flag, the “Appeal to Heaven” flag, was flown outside Alito’s beach vacation home last summer, while an inverted American flag, also carried by rioters, was seen at his home outside Washington after the Capitol riot. Alito claimed no involvement in displaying the American flag.

The “Appeal to Heaven” flag seen at Alito’s beach home is a symbol generally associated with conservatives, Christian nationalism, and support for Trump. It was also carried by some rioters during the Capitol attack fueled by the “Stop the Steal” movement. Republicans in Congress and state officials have also displayed this flag, including House Speaker Mike Johnson. Alito is currently involved in two Supreme Court cases related to January 6, involving Trump’s immunity from prosecution related to overturning the 2020 election and potential obstruction charges against rioters. Calls have been made for Alito and Justice Clarence Thomas to recuse themselves from these cases due to potential conflicts of interest.

Judicial ethics codes emphasize the need for judges to remain independent and avoid making political statements on matters they may have to decide. The Supreme Court recently adopted its own code of ethics, lacking enforcement mechanisms but aiming to address criticisms over undisclosed trips and gifts to justices from wealthy benefactors. Despite the calls for recusal, there has been no indication that Alito or Thomas would step aside from the cases related to the January 6 riot. Ocasio-Cortez emphasized the need for Democrats to use their power to ensure accountability and defend democracy, stating that active investigations and subpoenas should be issued immediately.

The reports of flags associated with the Capitol riot being flown at Justice Alito’s home have raised concerns about the impartiality of the Supreme Court in cases related to the January 6 incident. The involvement of Alito and Thomas in these cases has sparked calls for recusal to avoid conflicts of interest. Alito has claimed no involvement in displaying the American flag, while the “Appeal to Heaven” flag seen at his beach home is symbolic of conservative and nationalist movements. Efforts to address these concerns have been met with limited responses from Alito and the Supreme Court, with no indication that they would step aside from the cases.

The debate over judicial ethics and conflicts of interest in the Supreme Court cases related to the January 6 riot reflects broader concerns about the court’s independence and transparency. The adoption of a code of ethics by the Supreme Court aimed to address criticisms over undisclosed influences on justices, but the lack of enforcement mechanisms raises questions about its effectiveness. Ocasio-Cortez’s calls for active investigations and accountability highlight the need for Democrats to use their power to defend democracy. As the investigations continue, the implications of Alito and Thomas’s involvement in these cases will be closely monitored to ensure a fair and impartial legal process.
