Cannon, a Florida Judge appointed by Trump, criticized DOJ special counsel Jack Smith for seeking to keep information from the public in the case against Trump for mishandling classified documents. In a filing, Cannon expressed disappointment in Smith and accused him of ignoring similar concerns in the past. She granted in part and denied in part Smith’s motions to seal and redact defense filings, stating that there was no basis to conclude that witness safety could not be protected while maintaining transparency. Cannon also expressed concern over the special counsel’s treatment of sealed materials in the case.

Cannon indefinitely suspended the start of the trial amidst legal disputes in the case, sparking backlash from legal experts who accused her of bias towards the former president. In her order, Cannon referenced Smith’s previous position on unsealing documents to refute defense allegations of prosecutorial misconduct. The filing also denied proposed redactions by Trump’s legal team but granted a merits’ hearing on the redactions in a separate motion. Trump, along with his co-defendants Walt Nauta and Carlos De Oliveira, face federal felony counts in the classified documents case unsealed in June 2023, as well as charges related to the January 6, 2021, U.S. Capitol riot.

The former president has been facing multiple legal challenges, including a criminal hush money trial in Manhattan where he’s accused of falsifying business records to conceal payments to Stormy Daniels during the 2016 presidential campaign. He also faces state felony charges in Georgia for attempting to overturn the state’s 2020 presidential election results. Despite the numerous legal battles, Trump has denied any wrongdoing and accused prosecutors of trying to influence his chances of winning the November election.

Cannon’s stern response to Smith and prosecutors in the classified documents case highlights the tension surrounding Trump’s legal troubles and the efforts to balance transparency with protecting witness safety and grand jury secrecy. The judge’s decision to suspend the trial while addressing legal disputes reflects the complex nature of the case and the scrutiny it has received from legal experts. As the proceedings continue, the outcome of Trump’s various legal challenges remains uncertain, but the ongoing legal battles underscore the political and legal ramifications of his actions during and after his presidency.
