A Texas death row inmate, Melissa Lucio, was convicted of capital murder in 2008 for the death of her two-year-old daughter Mariah Alvarez. However, a judge recently recommended overturning her conviction after new evidence showed the girl died from an accidental fall. Lucio always maintained her innocence and claimed prosecutors relied on false testimony and flawed evidence. She was arrested in 2007 when Mariah turned purple and unresponsive at home in Brownsville, Texas.

Cameron County District Court Judge Arturo Nelson found Lucio to be “actually innocent” and did not kill her daughter based on the new evidence presented during the case. Prosecutors had alleged at the time that Mariah had numerous signs of trauma and bruising on her body, indicating physical abuse. Her husband, Robert Alvarez, also denied causing the child’s death, and one of their other children reported witnessing Mariah’s fall. The case caught the attention of reality TV star Kim Kardashian in 2022 when Lucio’s children penned a letter to Texas authorities pleading for their mother’s life to be spared. The children asked for closure and peace and expressed their hope that their mother’s death sentence would be dropped.

Kardashian described the children’s letter as heartbreaking and expressed her opposition to the death penalty. She called for Lucio’s life to be spared and questioned the evidence used in the case. The Texas Court of Criminal Appeals will now rule on whether to accept Judge Nelson’s recommendation to overrule Lucio’s murder conviction and death sentence. If Lucio remains on death row, she would be the first Latina put to death by Texas.
