A formal complaint has been lodged against New York Governor Kathy Hochul and other New York Democrats, accusing them of using their government positions to secure luxury suite tickets for a Buffalo Bills vs. Dallas Cowboys game. The complaint was filed by lawyer David Grandeu with the New York State Commission on Ethics and Lobbying in Government, claiming that the officials abused their power for personal benefit. The “I Love New York” suite where they were seated is controlled by the Empire State Development Corp. (ESD), which reports to Governor Hochul. The suite is typically used to promote New York’s economy and has 16 seats.

Hochul, a die-hard Buffalo Bills fan, was joined in the luxury suite by New York State Assembly Speaker Carl Heastie and New York Majority Leader Crystal Peoples-Stokes for the game on December 17, 2023. Photos of the officials at the game were posted on social media, with Hochul joking about Heastie being a Cowboys fan. The Bills ended up defeating the Cowboys 31-10. ESD reported that charitable donations equal to the value of the seats in the suite were made, and Hochul’s office stated that proper steps were taken to sit in the suite. The donation was made to FeedMore WNY, and there were discussions about regional infrastructure and economic growth during the game.

A.J. Baynes, CEO of the Amherst Chamber of Commerce, confirmed that there were productive discussions on infrastructure with Governor Hochul in the suite. ESD spokesperson Matthew Gorton noted that Heastie’s office had requested the use of the suite, and all guests were informed about the rules regarding lobbyists’ attendance and reporting requirements. However, Grandeu believes that the charitable donations do not excuse the officials’ use of the suite for personal benefit instead of official business. He argues that using a government position to attend a sporting event in a luxury suite is unethical and should not be allowed.

The controversy surrounding the officials’ attendance at the game has sparked debate about the misuse of government positions for personal gain. Governor Hochul’s office maintains that the proper guidelines were followed, including paying for the tickets out of personal funds. However, critics like Grandeu argue that the use of the suite was inappropriate and constituted an abuse of power. The situation has raised questions about the line between personal enjoyment and official duties for government officials, especially in the context of accepting perks and privileges that may not be available to the general public.

The complaint against Governor Hochul and other New York Democrats highlights the challenges of maintaining ethical standards in government and avoiding conflicts of interest. The accusation of using a government position to secure luxury suite tickets for a sporting event has drawn attention to the need for transparency and accountability in public officials’ actions. The outcome of the complaint will likely have implications for how officials navigate similar situations in the future and the extent to which they can engage in activities that may be perceived as personal rather than official. The controversy serves as a reminder of the importance of upholding ethical standards in public service and avoiding actions that could undermine the public’s trust in government.
