The International Court of Justice (ICJ) has issued new provisional measures ordering Israel to open more land crossings to allow aid into Gaza. The judges unanimously ordered Israel to take all necessary action to ensure basic food supplies reach the Palestinian population in Gaza without delay. They stated that Palestinians in Gaza are facing worsening conditions of life, with famine and starvation spreading. The court observed that at least 31 people, including 27 children, have already died of malnutrition and dehydration. In a legally binding order, the ICJ instructed Israel to take effective measures to ensure the unhindered provision of urgently needed basic services and humanitarian assistance, including food, water, fuel, and medical supplies.
The measures were requested by South Africa as part of an ongoing case accusing Israel of carrying out genocide in Gaza. In January, the ICJ had ordered Israel to refrain from acts that could be considered under the Genocide Convention and to prevent genocidal acts against Palestinians. The recent order reaffirmed these measures and added that Israel must ensure the unhindered provision of basic services and humanitarian aid throughout Gaza. The court ordered Israel to increase the capacity and number of land crossings and maintain them open for as long as necessary. Israel has been instructed to submit a report within a month detailing how it has implemented the ruling.
The current situation in Gaza is dire, with severe shortages of humanitarian aid due to Israeli restrictions. This comes as Israel continues its military assault on Gaza, which began over five months ago in response to a Hamas-led attack on southern Israel. The Israeli assault has resulted in significant death tolls on both sides, with civilians bearing the brunt of the casualties. The court noted that previous orders do not fully address the consequences of changes in the situation in Gaza, leading to the additional measures.
The ICJ’s new measures are an enhancement and modification of previous provisional measures, highlighting the worsening situation in Gaza. The court stressed that the famine in Gaza is now setting in, indicating a critical need for urgent action. Israel has not provided an immediate response to the court’s order. Earlier this month, Israel rejected South Africa’s request for additional measures, describing the claims as unfounded and morally repugnant. The ICJ expects Israel to comply with the measures and ensure the provision of basic services and humanitarian aid to the population in Gaza.
The court’s ruling underscores the urgent humanitarian crisis in Gaza and the need for immediate action to alleviate the suffering of the Palestinian population. The ICJ’s measures aim to hold Israel accountable for its actions in Gaza and ensure the rights and well-being of the civilians in the region. As the situation continues to deteriorate, the international community must work together to address the crisis and provide essential aid to those in need. Israel’s compliance with the court’s orders is crucial in mitigating the impact of the ongoing conflict and ensuring the protection of civilians in Gaza.
